By utilizing the Website and/or Huttiy Service you confirm that you possess the rights, authority and capability to accept and adhere to our Terms of Use. We are not obliged to monitor or regulate user activities, on both platforms. Website and Huttiy Service. However we maintain the right to observe, store and reveal any data as mandated by law, regulations, legal procedures requests, from authorities or to ensure adherence to the Terms of Service or other applicable guidelines. When a user’s ad gets removed and their access, to the Huttiy Service is stopped any content we choose to delete will be taken down. In some cases this might also lead to restrictions on further site usage or the use of a User Identifier. If the issue concerns a restriction, suspension or termination by Huttiy.ie you will have the chance to explain the circumstances surrounding it. After reviewing all information provided the officer will promptly communicate their decision to you once they have received all details. We strive to resolve disputes and complaints in a manner. However if you are dissatisfied, with the resolution you can escalate the matter to a dispute resolution body instead of going to court. Business Users are advised to refer to Clause 19 for information.

14. Disputes with third parties

Please notify us promptly if there are any claims or legal threats related to your use of the Website or Huttiy Service. If requested please stop the actions in question immediately. Also be ready to provide written details of the claim upon our request. If you fail to stop the actions we may need to take action against you.

15. Payment for advertisements

When you post an ad or use services on Huttiy.ie there are currently no charges involved. However this may change in the future. Any applicable fees will be clearly communicated on the website. The fee structure is explained in detail when you place an ad on the site with all fees quoted in euros and inclusive of VAT. Payments must be made in euros. However it's important to note that this email is not a confirmation of your order being accepted. We will only approve your request to post an ad on the Website once we review the ad to publish on Huttiy. Ads will be shown for the specified duration indicated on the ad entry page for each type of ad. If you want to extend this timeframe you'll need to make a request for Huttiy Service. The responsibility for the content of ads displayed on the Website lies with advertisers. Advertisers must ensure that their content complies with laws. We are not liable for any errors, omissions or inaccuracies in content. Please keep in mind that published ads represent the opinions of users and do not necessarily reflect Huttiy.ie views. Therefore advertisers should ensure their ads are not defamatory, unlawful or harmful to any party. Advertisers are fully responsible as both creators and publishers of their ads. The order in which ads appear in search results on our Website depends on factors such, as whether the advertiser has paid for premium placement of their ad. If a user has set filters or sorting preferences while conducting a search it may influence the results they see. Additionally the users previous search activity, on the website could also play a role in determining the ranking of results. Any data shared during your relationship with Huttiy will not be accessible once your account is terminated. We store Business Users personal data as, per our Privacy Policy guidelines. If your account or access, to our website is terminated based on clause 12 you will be given the chance to explain the reasons behind your suspension or termination through our complaint procedure. This process is outlined in detail Similarly you have the option to end this agreement at any time (after meeting the required notice period) by either emailing us or deleting your account. Handling Complaints and Mediation Our goal is to treat all Business Users transparently. We have a system for handling complaints to Business Users for issues such as; Alleged non-compliance by Huttiy with any obligations in the Platform to Business Regulation that impact the complaining Business User. Technological problems directly related to providing our services that affect the Business User. Actions taken by Huttiy or behaviours that directly impact providing our services and affect the Business User. The process, for handling complaints starts with Business Users sending their complaint to complaints@Huttiy.ie. The procedure then unfolds as follows; 1. You'll get a confirmation once we've received your email regarding any concerns you may have. A dedicated representative, from Huttiy will be assigned to your case. Will reach out to you within 3 working days. Depending on the nature of your concern our representative may ask for documents to understand your situation. 2. Our representative will carefully examine all the information provided including whether you have followed Huttiy’s Terms of Use and Policies. If your concern involves a restriction, suspension or termination, by Huttiy you'll have the chance to explain the circumstances that led to it. 3. After reviewing all details our representative will share their decision with you within 15 business days after receiving all necessary information. You'll have the opportunity to review and comment on this decision. 4. We'll take into account any feedback received. Then finalize our decision regarding your concern.

20. Fair usage policy

Our fair usage policy aims to enhance the browsing experience of our users whether they are buyers or renters. We kindly ask that each property is represented by one advertisement. This guideline ensures that properties are accurately placed in search results leading to smoother sale or rental transactions. Advertisements may be removed if they violate any of the following conditions; 1. Including properties, in a listing. 2. Listing the property across sections. 3. Listing the property across counties. Following these rules simplifies the property search process for buyers and tenants while making it easier to remove advertisements when a property is longer available. Failure to comply with this policy may result in the removal of offending advertisements from our website without notice or refund.

21. Reporting breaches

If you come across any advertisement that violates our User Agreement is illegal or otherwise objectionable please utilizing the 'Report this Ad' feature on our website to bring it to our attention. If you do not wish to report illegal content under the Digital Services Act, and instead wish to draw our attention to content for other reasons, please use the general "report ad" functionality available on the ad.

We are not liable for the properties you advertise buy or rent on the Website or for the ad content. 24. Consequences for failure to comply with the Agreement

Your failure to adhere to the User Agreement may lead to the following measures: 1. Immediate, temporary or permanent loss of access to your Website and/or Huttiy Service. 2. Immediate, temporary or permanent removal of any posts, material or Content you uploaded. 3. Receiving a private warning. 4. Limits on your posting frequency. 5. Suspension, restriction or reduction of rights. 6. Legal action against you for all costs from breaching the agreement. 7. Pursuing actions, as necessary. We may share details, with law enforcement as stated in our Privacy Policy. We do not hold responsibility for responses to breaches. Our actions in cases are not limited to those listed. If a right or remedy provided in the User Agreement or by law is not exercised promptly or delayed it doesn't mean giving up that right or remedy. Does it waive rights or remedies. Using a part of a right or remedy, under the User Agreement or by law doesn't stop use of that right or another one. The rights and remedies in the User Agreement are additional. Don't replace rights provided by law.

37. Severability

If any part of a provision in the User Agreement becomes illegal, invalid or unenforceable in any jurisdiction it won't affect the legality, validity and enforceability of the remaining parts of that provision under that jurisdictions law.
